QUINCY — A Quincy man may spend 30 years in prison if a plea deal is finalized later this week.
Stephen A. Mosley, 37, was in court on Wednesday for a pretrial hearing, with attorney Andrew Schnack telling the court that the defense was ready to proceed to trial pending some scheduling issues with expert witnesses.
Mosley is being held in custody following his arrest in February on three counts of murder following the shooting death of Damien C. Gardner. Following a brief but involved search, law enforcement took Mosley into custody just over 12 hours after the shooting.
One matter discussed at Wednesday’s hearing was the possibility of a deal that would potentially see Shelby Wires testify against Mosley. Wires, 34, is facing charges of concealing a fugitive and obstruction of justice in relation to the case.
Wires, along with another woman, Kimberly Brown, 21, is alleged to have given Mosley a place to hide from authorities and to have thrown his cellphone into the river. Both women have additional cases working through the system as well.
Judge Holly Henze set a hearing date for June 23 in the case before Mosley had a brief discussion with Schnack.
At Henze’s direction to avoid confidential information being shared in open court, Schnack went into the judge’s chambers with Adams County State’s Attorney Todd Eyler and Assistant State’s Attorney Laura Keck to negotiate while Henze continued with her regular docket from the bench.
After the brief closed-door discussion, Schnack told the court that Mosley was willing to accept a fully negotiated plea that would see him sentenced to 30 years in prison, to be served at 100%, with credit for time served, which would amount to around four months since Mosley’s February arrest.
Schnack proposed completing the deal during Wednesday’s hearing, but Keck told the court they could not agree to that because other people connected with the victim would need to be notified of any potential deal.
